Copyright Issue . . . oh the frustrations . . .
I am a member of an online photographers forum and one topic that is always being discussed is Copyright Infringement. You might wonder what is Copyright infringement? Well, it’s when someone uses a photo in a way that they have not had permission to do so or without paying for the right to do so.
Copyright is a big and sometimes confusing topic. When I talk about Copyright I am referring to US Copyright Laws because the laws are different in Canada and other countries. The bottom line is this . . . the minute a person click the shutter button, they own the image they just created. This applies to anything that anyone creates be it a photo, a painting, a song, a movie, a book, etc., etc. and no-one has the right to use those created pieces without permission from the artist. To do so is breaking the law.
And, the photo or other creation is protected even if there is no copyright symbol or signature on it.
Some people think that if they purchase a print then they should be able to do whatever they want with that print. Sorry, but this is NOT the case. When a person purchases a print (for personal use), they have purchased the right to display that print in their home, office, etc., for their viewing pleasure. If they want additional prints to give as gifts or to use on websites or for advertising, they need to contact the photographer to discuss Use Licenses and the cost involved.
Photographers and other artist have spent a lot of years and probably a lot of money on their trade and they usually have a very deep passion for what ever they are doing and creating. Serious artist are professionals just like accountants, plumbers, home builders, etc., unfortunately a lot of people do not see it that way.
Photographers take it pretty hard when they find their images have been stolen and are being used on sites such as facebook, MySpace, Dream Horse and Craig’s List. And yes, we do see them, I just saw one of mine on Dream Horse this morning!! And using a photo to advertise your horse or business, well that’s a whole other issue which I will explain in a future post.
A lot of photographer offer a low resolution digital file for the purpose of being used on the sites mentioned above. These are usually offered at a relatively low cost and sometimes included if you purchase a print. I personally offer a Free Low Res file with the purchase of an 8×10 or larger print or the file can be purchased all by itself for 20.00.

House of the Friesians
Over the last few years I’ve had the great pleasure of photographing some of the most beautiful Friesian horses!!! These horses and their owner, Gerard Paagman, of the House of the Friesians, put on some spectacular performances at the North Idaho Draft Horse & Mule International Show.
Not only are these some of the most beautiful horses you’ll ever see, but their owner Gerard, his family and those that work with him, are some of the nicest people you will ever meet.
This year they performed a Chariot Race and the winner “got the girl”, it was very exciting!!! They also had an Eight in Hand performance that was out of this world!!!
The driver of the Eight in Hand drives for her Majesty Queen Beatrix of The Netherlands and she now has one of my images hanging in the main room of the Royal Stables!!!!

Friesian Stallion Digital Painting
The post I did on Digital Paintings got my creative juices flowing. Here is one that I just finished working on. This is a Friesian Stallion named Gerrit fan Tuls, who lives in Canada.
WOW, is he beautiful or what!?!?!?!

I started playing with Digital Painting a couple of years ago. I absolutely LOVE this process and the effect it can have on an image. Not all images are good candidates for Digital Paintings, but when I see one that I think will work, I can’t wait to get started on it.
Below you will see some Before and After samples of my Digital Paintings. Some programs will let you “Auto Paint” a photo to make it look like a painting. Although the program I use offers that option, I do not use auto painting.
My Digital Paintings take hours and even days to complete. I choose the brush type and size, the opacity of the painting effect, etc. I paint every pixel of the image and will usually have 5 or more painted layers by the time I am done.
Although it’s very time consuming, I love the effect it gives an image. Sometimes the effect is dramatic and very noticeable, other times it’s very subtle.
I’ve included “close up” veiws of each image so you can better see the difference in the original photo and the digitally painted version. You can also click on each image for a larger view.

What is the best times of the day for taking pictures?
Although no-one gave the answer I was looking for, I want to send each of you a little something to Thank You for your participation.

Although there will always be exceptions to every rule, there are 2 times of the day that are usually the best for taking photos. This can be photos of people and-or other things and again, there are always exception. But if I am going to schedule an outdoor photo shoot I will usually try to do it during these 2 times of the day. I’m sure most of you have heard of the “golden hour” and there are actually 2 of them a day.
The answer is . . . . .
Just before and just after Sunrise and Sunset.
The light during these 2 times generally has a warmer, more rich color. The light has a much softer effect and seems to wrap itself around everything.
Have you ever looked outside just before or after sunset and everything seems to just be glowing?
It is so beautiful and this is an amazing time to get some good pictures!!!

If you haven’t read my other post, I had A real problem when my hosting service moved my files to another server, for maintenance purposes. In doing so it made my site not work at all!!! I’ve reinstalled most things and I am working on getting the rest of it back up and running.
